Usage Agreement for the Gardia Emergency Bracelet

This agreement governs the free provision of a Gardia emergency bracelet by microsynetics GmbH to the customer

  1. Subject Matter and Purpose of the Agreement: microsynetics GmbH provides the customer with the Gardia emergency bracelet for free use. The bracelet is intended to support the customer in emergency situations.
  2. Duration of Use: The use begins upon reimbursement by the long-term care insurance fund and ends when this reimbursement is cancelled. The customer can terminate the contract at any time.
  3. Ownership: Ownership of the Gardia emergency bracelet remains with microsynetics GmbH at all times.
  4. Customer Obligations: The customer undertakes to: Treat the bracelet with care and use it exclusively for its intended purpose. Return the bracelet in a functional condition after the contract ends.
  5. Return of the bracelet: Upon termination of the contractual relationship, whether by customer cancellation or by cessation of reimbursement by the long-term care insurance fund, the customer is obliged to return the bracelet immediately to microsynetics GmbH. Upon request, microsynetics GmbH will provide the customer with a shipping label. The bracelet must be returned in a proper and functional condition.
  6. Liability and Warranty: microsynetics GmbH is not liable for damages resulting from improper use of the bracelet. In the event of technical defects in the bracelet not caused by the customer, microsynetics GmbH will, at its discretion, provide a replacement device or carry out a repair.
  7. Compensation for Damage, Loss, or Destruction: If the bracelet is damaged, destroyed, or lost by the customer, the customer is obliged to pay compensation of £199.95 to microsynetics GmbH.
  8. Data Protection: The Gardia emergency bracelet may collect personal data. The processing of this data is exclusively for the purpose of emergency assistance and is subject to applicable data protection regulations. Further information on data processing can be found in the privacy policy of microsynetics GmbH.
  9. Contract Amendments and Additions: Amendments or additions to this contract must be made in writing. Oral side agreements are not valid.
  10. Place of Jurisdiction: For all disputes arising from this contract, the place of jurisdiction is the registered office of microsynetics GmbH.
